Our parents and grandparents raised us, and it is our moral and ethical duty to do everything we can to help provide for their needs and welfare as they grow older. Oftentimes, this means engaging the services of a nursing home or skilled nursing facilities that can provide the daily care and attention to our elders’ physical, social, and medical needs better than we can on our own. What is Elder Abuse in California?

California state law provides strong protections against elder abuse by providing a legal cause of action giving elders and their families the ability to file a lawsuit for financial damages against those who commit elder abuse and their employers. Under the California Elder Abuse and Dependent Adult Civil Protection Act, dependent adults and anyone 65 or over can file a lawsuit when they have suffered acts constituting:
  • Physical abuse (assault, use of restraints, etc.)
  • Mental abuse (screaming, insults, etc.)
  • Sexual abuse (rape, inappropriate touching, etc.)
  • Neglect (failure to provide needed food, care, toiletries, services, etc.)
  • Financial abuse (taking property, undue influence, etc.)
