About 30 years ago, a distraught, young mother came to us seeking both legal and biblical counsel. Tragically, her two year old son had drowned in a neighbor’s pool when a gate latch failed and allowed the little boy to enter.
Sadly, that was not the end of it. What followed demonstrates why injured Christians should consider seeking legal counsel.
“You can’t sue another Christian!”
Shortly after the drowning incident, the insurance company sent an adjuster to assess the situation and make an offer. Upon arriving, the adjuster was instructed by the neighbor to offer the full policy limit to the mother. However, the adjuster knew that the State of California required the injured party to sue the insured, not the insurer. The adjuster also knew that the mother and neighbor were unlikely to sue one another because they were both Christians. So instead of offering the full policy limit to the mother, the adjuster made a much lower offer.
When the young mother heard the offer from the adjuster, she thought the insurance company might be holding back and told the adjuster that she would like to consult a lawyer. Incredibly, the adjuster accusingly replied, “You can’t sue another Christian!”
Confused, the mother decided she should consult a pastor. The pastor knew the insurance company was taking advantage of her, and he knew a couple of Christian lawyers who could help her – David Berglund and Daniel Johnson.
Over the years, our team has helped hundreds of Christians recover losses which insurance companies refused to pay out. Still, many more Christians have been taken advantage of simply because they think it wrong to seek legal counsel. However, there is nothing wrong with legal counsel, and sometimes there is nothing wrong with a lawsuit.
